1. INTRODUCTION
Welcome to Tempo Art.
These Terms and Conditions govern your use of the Tempo Art website and any purchases, enquiries, bookings or services provided through the website.
By accessing this website, placing an order, submitting an enquiry or using any Tempo Art services, you agree to be bound by these Terms and Conditions.

2. PRODUCTS AND SERVICES
Tempo Art offers original artwork, fine art prints, framed artwork, commissioned artwork, Art for Spaces solutions, colouring books, children's books, art lessons, tutoring services, educational products and other creative services.
Product images are intended to accurately represent products. Actual colours and finishes may vary depending on screen settings, lighting conditions and printing processes.
3. PRICING
All prices are displayed in South African Rand (ZAR).
Tempo Fitness (Pty) Ltd t/a Tempo Art is currently not registered as a Value Added Tax (VAT) vendor. No VAT is charged unless otherwise stated in future.
Prices are subject to change without notice. The price applicable to an order will be the price displayed at the time the order is placed and paid for.
4. ORDERS
Orders are subject to availability and acceptance.
Tempo Art may refuse or cancel orders affected by pricing errors, product unavailability, suspected fraud, abuse or technical errors.
If an order is cancelled after payment has been received, the customer will be refunded in accordance with applicable law.
5. PAYMENT
Payments are processed through approved third-party payment providers.
Available payment methods may include Visa, Mastercard, American Express, Apple Pay, Google Pay, Samsung Pay, Instant EFT, Payflex and other payment methods made available from time to time.
Tempo Art does not store full payment card details.
6. DELIVERY
Delivery times displayed on the website are estimates only and may vary due to product availability, courier capacity, destination, public holidays, weather conditions, custom framing or production requirements.
Risk in goods passes to the customer upon successful delivery.
Customers are responsible for ensuring that delivery information supplied is accurate.
7. ORIGINAL ARTWORK
Original artworks are unique pieces created by the artist.
Minor variations in colour, texture and appearance are natural characteristics of original artwork and do not constitute defects.
Ownership of the physical artwork transfers to the purchaser upon full payment.
Copyright and reproduction rights remain with the artist unless otherwise agreed in writing.
8. ART PRINTS
Art prints are produced using professional printing methods.
Colours may vary slightly between printed products and images displayed online.
Print sizes and specifications are displayed as accurately as possible.
9. COMMISSIONED ARTWORK
Custom commissioned artwork is created according to customer requirements.
Once work has commenced, deposits may be non-refundable.
Timeframes for commissioned work are estimates and may vary depending on project complexity.
Unless otherwise agreed in writing, copyright remains the property of the artist.
10. ART LESSONS AND TUTORING
Tempo Art may provide educational services including art lessons, tutoring, workshops and creative development programmes.
Booking confirmations, schedules and cancellation arrangements may be communicated separately where applicable.
11. RETURNS AND REFUNDS
Customers may request returns in accordance with applicable South African consumer protection legislation.
Returns may be declined where products were customised or commissioned, have been used or damaged after delivery, or cannot reasonably be resold.
Refunds will be processed using the original payment method where possible.
Tempo Art reserves the right to inspect returned products before approving refunds.
12. INTELLECTUAL PROPERTY
All website content remains the property of Tempo Art and its licensors, including artwork, images, logos, designs, product descriptions, text content and educational materials.
No content may be copied, reproduced, distributed or used without prior written permission.
13. WEBSITE USE
Users agree not to use the website unlawfully, attempt unauthorised access, upload malicious content, interfere with website functionality or misrepresent their identity.
Tempo Art may restrict access where misuse is detected.
14. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Tempo Art shall not be liable for indirect losses, consequential losses, business interruption, courier delays, third-party service failures or technical interruptions.
Nothing in these Terms excludes liability where such exclusion is prohibited by law.
15. PRIVACY
The collection and processing of personal information is governed by the Tempo Art Privacy & Data Protection Policy.
By using the website, you consent to the collection and processing of personal information as described in that policy.
16. CHANGES TO THESE TERMS
Tempo Art may update these Terms and Conditions from time to time.
Any changes will become effective upon publication on the website.
Continued use of the website constitutes acceptance of any updated version.
17. GOVERNING LAW
These Terms and Conditions are governed by the laws of the Republic of South Africa.
Any disputes shall be subject to the jurisdiction of the South African courts.
